NEW YORK — U. S. drug company Merck has agreed to buy about one-quarter of Merck’s portfolio of hair loss treatments, and to pay $2 billion in fines and penalties for violating the federal Food, Drug and Cosmetic Act.

The two companies have been in litigation for several months in which they sought to stop selling Merck’s products, which have been used to treat male-pattern baldness.

“I don’t see it as a time for the companies to have a new perspective on this,” said Dr. David H. Lee, Merck’s vice president of dermatology. “When you look at the way we treat this, we don’t want to change. We want to get a new perspective on this.”

The company’s baldness drugs, which were marketed as treatments for men’s hair loss, had a combined annual sales of $7.2 billion in the United States between 1999 and 2004, according to a report by the Center for Individual and Family Health in Washington.
